1. Acceptance of Terms
By accessing or using HorrorSchool (“the Service”), operated by Destination Creation, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not access or use the Service. You must be at least 18 years old to use HorrorSchool. Use of the Service by minors is strictly prohibited.
2. The Service and “Blood” Credits
HorrorSchool provides AI-powered creative tools. Access to these tools is metered via a virtual currency called “Blood.”
- Purchases: “Blood” is granted via recurring monthly membership tiers or one-time “Emergency Splash” top-up packs.
- No Cash Value: “Blood” credits are a limited license to access computational resources. They have no real-world monetary value, cannot be sold or exchanged for fiat currency, and are non-transferable between accounts.
- Refund Policy: Due to the immediate and high computational costs of AI generation, all purchases are final and non-refundable. * Failed Generations: If a generation fails due to a system error or an AI safety filter trigger, “Blood” will not be deducted. However, “Blood” will not be refunded for outputs that the user simply finds aesthetically unappealing.
3. Content Ownership and License
- Your Ownership: As between you and HorrorSchool, you retain ownership of the text prompts and images you upload (“Inputs”) and the scripts, images, or videos generated (“Outputs”), subject to these Terms and applicable copyright laws (which vary by jurisdiction regarding AI-generated works).
- Our License: To provide the Service, you grant HorrorSchool a worldwide, non-exclusive, royalty-free license to host, process, and store your Inputs and Outputs. This includes the right to display your content within your private Vault or, if you explicitly opt-in, to the community-facing “Hall of Horrors” or social feeds.
- Attribution: While not required for personal use, we encourage tagging “Created on HorrorSchool.com” when sharing outputs on social media.
4. Acceptable Use Policy (AUP)
HorrorSchool is built for cinematic, fictional horror. We celebrate the macabre, but we maintain a zero-tolerance policy for real-world harm. You may not use the Service to generate, upload, or share:
- Non-consensual Likenesses: Creating deepfakes or using the likeness of real individuals without their express permission.
- Exploitation of Minors: Any content depicting the harm or sexualization of minors.
- Real-World Violence: Promoting real-world terrorism, hate groups, or “snuff” style content that blurs the line between fiction and reality.
- Harassment: Using the Service to bully or threaten specific individuals.
- Illegal Acts: Promoting or instructing on how to perform illegal activities.
Violation of this AUP will result in immediate account termination without a refund and, where required, reporting to relevant law enforcement.
5. Intellectual Property of HorrorSchool
The “HorrorSchool” name, the “Nightmare Engine,” “Darkroom,” “Vault” branding, logos, and the website’s original code and design are the exclusive property of Destination Creation and are protected by copyright and trademark laws.
6. Disclaimer of Warranties
Generative AI is inherently experimental and unpredictable.
- The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
- We do not guarantee that the Outputs will meet your specific creative expectations or be free from artifacts or “hallucinations.”
- We do not guarantee 100% uptime, as we rely on third-party API providers..
7. Limitation of Liability
To the maximum extent permitted by law, HorrorSchool and Destination Creation shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service, your inability to use the Service, or the nature of the content you generate. Our total liability for any claim shall not exceed the amount you paid for the Service in the three (3) months preceding the claim.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles.
9. Changes to these Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via the email associated with your account or a prominent notice on the platform. Continued use of the Service after changes constitute acceptance of the new Terms.
